Professional withholding tax exemption: a scheme under pressure

Every year, thousands of businesses benefit from withholding tax exemption schemes in order to reduce their wage costs. These measures, designed to encourage employment, innovation and competitiveness, are under increasing scrutiny by the tax authorities.

A valuable tax measure... but costly

In 2023, around 148,000 businesses benefited from at least one form ofexemption from withholding tax.

These exemption regimes cover in particular:

  • working in a team or at night,
  • research and development (R&D),
  • and since 2024, new sectors such as fruit and vegetable agriculture.

Together, these systems represent 82% of tax expenditures related to exemptions, with a particular effort made in favor of R&D (1.4 billion euros) and the teamwork or At night (2 billion euros).

Intensification of fiscal controls

In 2024, 193 million euros were recovered from companies that, according to the authorities, erroneously applied exemption mechanisms. The teamwork is particularly targeted, with 123 million claimed, compared to only 20 million in 2021. This tightening is explained in particular by a ruling by the Constitutional Court specifying that the advantage only applies if the alternating teams are of equal size and perform the same work.

Research & development: a climate of uncertainty
